Terms of Service
Effective date: June 8, 2026
1. Agreement
These Terms of Service (“Terms”) form a binding agreement between you and ManyMarketing AI (“we,” “us,” or “our”) governing your use of our websites, applications, APIs, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract under the laws of your jurisdiction. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
3. Subscriptions, billing & auto-renewal (California & Canada disclosures)
- Paid plans renew automatically on a monthly or annual basis until cancelled, in compliance with California’s Automatic Renewal Law (Cal. Bus. & Prof. Code § 17602) and equivalent Canadian consumer-protection requirements (e.g., Quebec Consumer Protection Act, Ontario CPA 2002).
- You will see the renewal cadence, amount, and currency before checkout. Annual plans are billed up front and provide a 20% discount versus monthly billing.
- You may cancel at any time from Settings → Billing or by emailing support@manymarketing.ai. Cancellation stops the next renewal; access continues until the end of the current billing period.
- Refunds: except where required by law, fees are non-refundable. California, Quebec, and other jurisdictions may grant statutory cancellation rights that override this clause; we will honor those rights.
- Applicable sales tax, GST/HST/QST, or VAT may be added at checkout and is collected by Stripe.
4. Acceptable use
You agree not to:
- Reverse engineer, resell, or sublicense the Service except as expressly permitted.
- Use the Service to generate unlawful, harassing, defamatory, or infringing content.
- Send spam, scrape disallowed data, or violate the rights of any third party.
- Attempt to gain unauthorized access to other accounts, systems, or data.
5. Your content & data
You retain ownership of the content you upload, generate, or import (“Customer Data”). You grant us a limited, non-exclusive license to host, process, and display Customer Data solely to operate and improve the Service for you. We process personal information as described in our Privacy Policy.
6. AI output
The Service uses third-party AI models to generate insights, drafts, and recommendations. AI output may be inaccurate or incomplete and must be reviewed before relying on it for business decisions. We make no warranty as to the accuracy, suitability, or non-infringement of AI-generated content.
7. Third-party services
The Service integrates with third parties (e.g., Stripe, Wix, WordPress, search and AI providers). Your use of those services is governed by their respective terms and policies, and we are not responsible for their acts or omissions.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as required by law.
9. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the Service. Our aggregate liability for any claim will not exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under California or Canadian law (including, without limitation, statutory consumer rights, gross negligence, fraud, or wilful misconduct).
10. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your Customer Data, your use of the Service in violation of these Terms, or your violation of applicable law.
11. Termination
We may suspend or terminate the Service for material breach, suspected fraud, or to comply with law. You may terminate by cancelling your subscription. Sections that by their nature should survive (e.g., fees owed, disclaimers, liability limits, dispute resolution) will survive termination.
12. Governing law & venue
If you reside in California: these Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in San Francisco County, California, subject to your statutory rights as a California consumer.
If you reside in Canada: these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, except that residents of Quebec may rely on the laws of Quebec, and you retain all mandatory protections under the consumer-protection legislation of your province (including Quebec’s Consumer Protection Act and Law 25). Nothing here deprives you of those statutory rights.
13. Dispute resolution
We encourage you to contact support@manymarketing.ai first so we can attempt to resolve any dispute informally within 30 days. Nothing in these Terms prevents you from filing a complaint with a government agency, including the California Department of Consumer Affairs (1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834; 1-833-955-2010) or the Office of the Privacy Commissioner of Canada.
14. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least 14 days before they take effect, except where a shorter period is required by law.
